OSHA created a rule in 2013 outside the usual rule-making process that allowed union representatives to accompany OSHA inspectors in non-unionized businesses. This allowed unions to gain entry into these businesses. The NFIB filed a lawsuit contesting the rule, and OSHA recently rescinded it.
