Say you own a corporation that’s in construction and you have it build a home for you. You reimburse all of the corporation’s costs and deal with the subcontractors yourself. The Tax Court says that the foregone profit (what the corporation could have earned if the work had been done for a third party) isn’t treated as a constructive dividend to you (the owner).
