The Department of Labor released a proposed rule that would expand the definition of “employer” with respect to Association Health Plans. This is designed to provide more flexibility in allowing employers to join together as a single group to purchase health coverage in the large group market. The impact of the new rule, when finalized, would allow employers to form a small business health plan without regard to geography or industry.
