According to an appellate court, obesity by itself is not an ADA impairment that requires an employer to make an accommodation. The case concerned a bus driver who was eventually terminated after the company tried to work with him to lose weight so he could safely operate the vehicle. There must be an underlying physiological cause to the obesity in order for a worker to be entitled to an accommodation.
